I am in a union

Generally speaking, employees represented by a union can't file a claim with the Ministry of Labour. If you are an employee who is represented by a trade union and covered by a collective agreement (whether or not you are actually a member of the union), your claim, if it is to be pursued, must be pursued through the grievance procedure in the collective agreement if you believe the ESA hasn't been followed.

The Ontario Labour Relations Board will have more information about unions and workplaces.
