I think my boss is wrong

The Ontario Ministry of Labour administers and enforces the Employment Standards Act, 2000 (ESA) and the regulations.

Ministry officers have strong enforcement powers to make sure employees are not penalized for asking questions about the ESA or for asking their employer to follow the Act. Officers conduct pro-active inspections, investigate complaints, and can issue orders to pay, compensate and reinstate.
