Occupational health and safety law is made up of the statute (the Occupational Health & Safety Act), the regulations made under the statute, and the common law (which includes the body of legal decisions that interpret the statute and regulations). The link www.e-laws.gov.on.ca/navigation?file=home&lang=en will take you to a Government of Ontario Website that contains most of Ontario's current statutes and regulations. To look for information about, for example, health and safety committee, click on "specific statute" and go to the Occupational Health & Safety Act in the alphabetical list under 'O'. Once there, click on "edit", then "find (on this page)" to look for "health and safety committee". Be sure to look for exceptions. You may also want to search for a "specific regulation" from the home page in eLaws. Go to the regulations under the Occupational Health & Safety Act and use the "find" feature.
Employment standards law is also made up of the statute (the Employment Standards Act, 2000), the regulations made under the statute, and the common law (which includes the body of legal decisions that interpret the statute and regulations). To look for information about, for example, minimum wage, click on "specific statute" and go to the Employment Standards Act, 2000 in the alphabetical list under 'E'. Once there, click on "edit", then "find (on this page)" to look for "minimum wage". Be sure to look for exceptions (employees and employers that the ESA does not apply to) in Part III of the Act. You may also want to search for a "specific regulation" from the home page in e-Laws. Go to the regulations under the Employment Standards Act, 2000 and use the "find" feature to look for specific information, for instance "minimum wage" and for "IX". (Because minimum wage is in Part IX of the Act, some exemptions and special rules may be found this way.) Special rules for employers and employees in the women's garment industry can be found in Regulation 291/01. |
